Don Anselmo probably wasn't aware about the tree and the children situation on the first time he visit the lawyer's office. In the story, the author describes Don Anselmo as an old hard working man, he didn't mention it because he might have amnesia or he just needs the money. Another reason could be this situation is a normal thing because he used to plant them trees and let them play with the garden every day. Don Anselmo considered that the tree is his descendants' properties.
